LEGAL GENDER RECOGNITION?

Update of HKID gender marker does not update legal gender. Hong Kong legal gender cannot be updated to this day.

According to ImmD's Guideline:

  • "The sex entry on a Hong Kong identity card serves as an “identifier” helping to verify the identity of the person producing the card as its holder and does not represent change of the holder’s sex as a matter of law and an official recognition of the same for all legal purposes".

G Dot TV further inquired regarding the application via the new application criteria, and the relevant declaration in the new policy:

Q: Have any applicants been required to change back their gender marker on HKID due to a failure to comply with the terms of the declaration?

  • ImmD: There have been no reports of corrections to registered particulars received thus far.

Q: Has the government initiated any prosecutions regarding violations of the declaration?

  • ImmD: No applicants have been found to be in violation of those regulations.

Q: How many individuals who successfully changed their ID cards have updated their contact information?

  • ImmD: Relevant statistical figures are not maintained.
